Kingston Road explosion

NOTICE OF AN IMPORTANT DEVELOPMENT

On February 18, 2010, class counsel will bring a motion before Justice Strathy to dismiss this action against Toronto Hydro. This decision was made based on reliable, detailed information indicating that Toronto Hydro did not own or operate any equipment in the electrical room where the explosion originated. OVERVIEW

On March 19, 2009, at approximately 2:30 a.m., an explosion took place in the electrical room of the building located at 3650 Kingston Road in Toronto ("Kingston Road"). The explosion originated in the electircal room. The transformer owned by Toronto Hydro also exploded.

The law firms of Sutts, Strosberg LLP and Falconer Charney LLP commenced a proposed class action against Toronto Hydro-Electric System Ltd. on behalf of all persons, who on March 19, 2009:

(i) rented or owned a unit at Kingston Road; or
(ii) ordinarily resided in a unit at Kingston Road; or
(iii) were present in a unit at Kingston Road but were not ordinarily resident in that unit; or
(iv) owned or had an interest in property located in or on a unit at Kingston Road; or
(v) owned some or all of the units at Kingston Road.

The force of the explosion caused significant damage to Kingston Road. The extent of the damage is not currently known.

The residents of Kingston Road were evacuated. Electrical service has been disrupted.

The proposed class action seeks compensation for, among other things, damage to the unit contents and the costs incurred for living expenses. The action also seeks damages for physical and emotional injury, damage to property, costs of cleaning and restoration of contents, relocation expenses such as mileage, food and alternative accommodation and loss of employment income.
